夫在、為妻者則受法律拘束；夫亡、則可自由再嫁、惟應依天主規律。

凡出妻而另娶者、姦也。娶人所出之妻者、亦姦也。

第吾語爾、妻非犯姦而出之者、是陷之於姦也；娶所出之妻、亦犯姦也；

至於已有家室者、予有命焉、豈第予命實主命也：妻不得離其夫、即離、當守獨身、或言歸於好；夫亦不得離其妻。至於其他、予自言焉非主言也：如兄弟中有不信教理之妻、而其妻願意與之同居、則勿離之；如姊妹中有不信教理之夫、而其夫願意與之同居、亦莫與之離。

據報爾中竟有奸其繼母者；如此淫亂、即在異邦人中、亦未之前聞。

耶穌曰：『出妻而他娶、是背妻而姦也。妻若離夫而別嫁、亦姦也。』

例如有夫之婦、其夫一日有生、即一日受制於法。其夫既死、即脫於其夫權之拘束。其夫存而改適者、是謂不貞。若夫既死、則無復法律之拘束、雖再嫁亦不為失貞。

為妻者對其自身不能自由處置、處置之權屬於乃夫；為夫者亦不能自由處置其自身、處置之權屬於乃妻。雙方不得彼此剝奪其權；
